Multi-territorial Licenses and their recent regulation in the Spanish legal system

The Royal Decree-Law 2/2018, of April 13, which modifies the Intellectual Property Law, regulates the multi-territorial licenses for the first time in Spain.

These multi-territorial authorizations are established by the Intellectual Property Law as a non-exclusive right, and modify the previous licensing system for musical works, putting an end to the difficulties faced by online music service providers when they wished to acquire licenses for many than one jurisdictional territory at a time in several Member States.

In this way, thanks to this type of multi-territorial licensing, online music service providers can obtain the necessary permission, through a single transboundary authorization, to exploit the rights of reproduction and public communication of works or musical repertoires in the territory of several Member States and even the entire European Union.

The processing of non-exclusive authorizations of online rights on musical works must be carried out by the management entities. Therefore, it is with these entities that the rates for the use of an entire repertoire will have to be negotiated.
