New developments in the management of sick leave

On 1 April 2023, Royal Decree 1060/2022 came into force, introducing changes to the management and monitoring system for sick leave processes.

The most relevant change of this new regulation is that workers will no longer be obliged to submit sick leave, confirmation and medical discharge reports to their employer.From now on, the procedure will be as follows:

– The doctor will give a copy of the medical sick leave report to the worker only.

– The worker must notify the company that he/she has obtained sick leave, but without the need to provide the physical document.

– The health centre will directly notify the National Social Security Institute (INSS) of the sick leave on the first working day following the day the leave is issued.

– The INSS will be responsible for notifying the companies on the first working day following receipt.

– The company will continue to be obliged to notify sick leave, but not confirmation and discharge reports. Likewise, the company will be obliged to submit sick leave economic data, together with the National Occupation Classification, the job position and the description of the tasks carried out by the worker.

These new features will provide a much more automated system for the management of temporary incapacity processes, both for companies and for the doctors themselves and, in turn, will facilitate the control of absenteeism within each company.
